Florida DUI Penalties

  • Second Offense:
    • Up to 9 months in jail (more if within 5 years of the first)
    • License suspension for up to 5 years
    • Fines up to $2,000
    • Mandatory installation of ignition interlock device


  • Third Offense or More (especially within 10 years):
    • Felony charges
    • Up to 5 years in prison
    • Fines over $5,000
    • Long-term license revocation


*Penalties increase with aggravating factors like high BAC levels, minors in the vehicle, or causing property damage or injury.
